  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Store Action & Procedure

Upon receipt of a valid and complete DMCA notice, Vibeforhim will take the following steps:

  • Expedited Removal: We will remove or disable access to the material that is claimed to be infringing.
  • Notification: We will take reasonable steps to promptly notify the user or vendor who posted the material that we have removed or disabled access to it.
  • Verification: We may request additional documentation or proof of ownership if the claim is unclear or lacks sufficient detail.

4. Counter-Notification Process

If you believe that your material that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notice containing the following information to our Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.
  • Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in North Carolina (or the jurisdiction in which your address is located), and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Vibeforhim has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users, vendors, or account holders who are deemed to be repeat infringers. We may also at our sole discretion limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
